This agreement describes the terms and conditions for your participation in the Carla Rieger Affiliate Program. The terms “Affiliate,” “you,” and “your” are referring to you, the applicant. “I”, “We” and “our” refer to Carla Rieger & The Artistry of Change Productions Inc. We are independent parties and this agreement will not form any partnership. AGREEMENT DURATION This agreement will begin upon our acceptance of your affiliate application and will end when terminated by either party. Termination may happen at any time, with or without cause, by giving the other party written notice of termination. COMMISSION FEES You will receive 50% of the revenue on sales of the digital products. Definition of a Lead that Comes through You This is a person who comes to me as a result of you promoting me, or as a result of putting me on a stage in front of your prospects and clients. For example, an event that you produce. The commission comes through people with whom you have invested marketing time, energy and money by building good will and credibility over time, or through their word-of-mouth contacts. In the case of a person with whom I have also built good will and credibility with over time, we will ensure we both understand how that prospect made their decision and apply commissions or not accordingly. We both intend to find a win-win outcome for all concerned whenever a difference of opinion comes into play. Communication Regarding Business Transactions When a person enrolls in or signs up to work with me it’s my obligation to ensure that lead informs us both how they heard about it. I understand this it is also my obligation to communicate what transactions occurs, what money has or will exchange hands, and to ensure commissions are paid to you 31-60 days after the date of sale (after the 30 day money back guarantee has taken affect). Processing of Payments and Money Back Guarantees There is a 30 day full money back guarantee. After that there are no refunds. If the client asks for their money back within the guidelines of the guarantee, then no commissions are paid out to the Affiliate. For a sale to generate a commission to an Affiliate, the client must complete the order form, remit full payment for the service ordered or have their installation payments completed. The client can pay all at once or in 2-3 payments. You receive affiliate commissions within 31-60 days after full or installment payment is made. You will be paid only on sales which are made through qualified Affiliates, in other words those who have received this agreement and signed it. Referral fees can only be earned between the acceptance of the Affiliate application and notice of termination. Any returned cheques, chargebacks, or fees from a returned order will be adjusted in the commission fee payment. I will be solely responsible for processing every order placed by a client sent by the Affiliate. clients who purchase the program through mentioning you as the person who referred them will be deemed your clients. Prices and availability of our products and services may vary from time to time. In the case of a client receiving a discount, or a partial trade, the commission is only paid on the amount received in currency. The group coaching program is by application only. We reserve the right to reject any order that does not comply with our guidelines and policies. RESTRICTIONS Affiliates who promote any of the following will not be accepted or may be terminated: • X- rated and or those who promote sexually explicit materials • Those who promote violence and discord. • Those who promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age • Those who promote illegal or questionable activities • Those who violate intellectual property rights SPAM (UCE) Unsolicited Commercial E-mail – Carla Rieger and The Artistry of Change in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from this Affiliate Program, with no refund. DISCLAIMER We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from this Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or down time. This Agreement will be governed by the laws of the Canada and the Province of British Columbia, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the Federal or Provincial courts located in (Vancouver, BC), and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
